The trivialization of the Holocaust by certain Romanian judges
The article titled “The Trivialization of the Holocaust by Certain Romanian Judges,” written by Prof. Corneliu-Liviu Popescu, Ph.D., was published in A.U.B.D. – Legal Forum No. 1/2026.
Public statements by certain judges—to the effect that the situation of Romanian judges, that is, of judges in a State Party to the European Convention on Human Rights and a Member State of the European Union, who are the subject of public debate and measures to curtail certain of their economic rights—is similar to that of the Jewish population during the Holocaust, along with Joseph Goebbels’ genocidal anti-Semitic propaganda and the requirement to wear the yellow star—which preceded the death camps and extermination—constitute acts of serious active trivialization of the Holocaust, prohibited by European Union law and by Romanian domestic law itself. The passivity of the Judicial Inspection and the Superior Council of Magistracy in exercising their disciplinary powers—by refusing to take action and thereby encouraging the perpetuation and amplification of acts of active trivialization—is contrary to those same European and national norms and constitutes a form of passive trivialization of the Shoah. The trivialization of the Holocaust (the Shoah), whether active or passive, constitutes a form of anti-Semitism that must be punished.
