Submission Guidelines

For publication in the AUBD Journal and AUBD – Legal Forum, submissions must be sent electronically to the email addressaubd@drept.unibuc.ro, specifying the journal in which the article is intended to appear. The journals publish materials by faculty members of the Faculty of Law at the University of Bucharest, as well as by undergraduate, master’s, and doctoral students of this faculty; by faculty members from similar departments in Romania and abroad; and by legal practitioners.
 
When preparing the materials, the following conditions must be taken into account:

Editing

– Authors assume full responsibility for compliance with copyright laws. Acceptance of materials submitted for publication constitutes the conclusion of a publishing contract, under which the authors grant AUBD the exclusive right to reproduce and distribute the material, including digital reproduction and electronic communication, anywhere in the world, for the entire duration of the work’s existence. The rights granted are transferable.

 

– Submissions must not have been previously published. Submissions may not be offered to other publications unless the AUBD editorial board has notified the author that the submission has been rejected.

 

– Authors are asked to provide, along with their first and last names, their profession, academic or scientific title, the institution where they work, their mailing address and email address, and a phone number where they can be reached.

 

– The AUBD Journal primarily publishes in English and French, but also accepts papers in Romanian. It is essential that all texts be written using the diacritical marks specific to the language in which the article is written.

 

– Texts must be typed in Microsoft Word (version 7.0 or later) using only Times New Roman (standard version), and must include the diacritical marks specific to the language in which the article is written. The font size shall be 12 for the text and 10 for footnotes (single-spaced), and all margins shall be 2 cm. The page size is A4. Paragraphs must be marked in the text by indentation or increased line spacing.

 

– Each submission must include, on the first page, the full title of the paper, the first and last names of the author(s), their profession, academic or scientific title, the institution where they are employed, and contact information: full address, email address, and phone number.

 

– Each paper must begin with an abstract written in Romanian, French, and English, which must not exceed 1,000 characters.

 

– The title of each submitted article must be written in Romanian, French, and English.

 
– Each document will be accompanied by a list of keywords in Romanian, French, and English, covering the main legal concepts, principles, or institutions relevant to the respective work.

 

Note: Forarticles submitted for publication in AUBD – Legal Forum, as an exception to the publication requirements, the title, abstract, and keywords in French are required only if the article is written in that language.

 

– When abbreviations are used, the full form of the word must appear first, with the abbreviation given in parentheses.

 

– It is recommended that the materials not exceed 25 pages.

 
– Articles will be evaluated according totheattachedreview formby two reviewers, whose favorable recommendation for publication is required. The review process is conducted in accordance withthe attached document.

GUIDELINES FOR SUBMITTING ARTICLES TO THE AUB AND AUBD JOURNAL – FORUM JURIDIC

I. ABBREVIATIONS

When the article number is not specified, the name of the legislative act is not abbreviated.
E.g.: this was the intention of the drafters of the Civil Code; Prof. Dongoroz is considered the architect of the 1969 Criminal Code; emergency ordinances should only be used in exceptional cases; criminal acts cannot be criminalized by government ordinance.
 
The same rule applies to courts as well.
E.g.: at the level of the courts of appeal, however, the practice of the courts determining jurisdiction has remained inconsistent; the district courts, however, have issued differing rulings on applications for authorization of the enforcement of credit agreements concluded online; The Constitutional Court, in ruling on the exception of unconstitutionality…; the High Court of Cassation and Justice, however, relied on other arguments in ruling on the appeal in the interest of the law.
  • A. Legislation:
  • Codes (Criminal, Civil, Administrative, etc.): Criminal Code; Civil Code; Administrative Code; Tax Code; Code of Criminal Procedure; Code of Civil Procedure; Code of Tax Procedure

*If a sentence ends with an abbreviation of a code, the period is not repeated.
Ex.: However, the solution does not follow from the provisions of Article 100 of the Code of Criminal Procedure.

  • Rules: never abbreviate.
  • Emergency Ordinance: E.O. (e.g., E.O. No. 1/2020).
  • Government Ordinance: G.O. (e.g., G.O. No. 1/2021).

Articles and subdivisions:

  • Article: Art. (e.g., Art. 1, Art. 2, Art. 3).
    · Paragraph: para. [e.g., para. (1), para. (2), para. (3)] (the paragraph number must be enclosed in parentheses).
  • Letter: lit. [e.g., lit. a), lit. b)].
  • Paragraph: para. (e.g., para. 1, para. 2, para. 3).
  • Point: pt. (e.g., pt. 1, pt. 2).
  • Index: E.g., Art. 31, Art. 133. Do not use the abbreviation “ind” or similar variations. If the reference is to a paragraph, it should be written as follows: Art. 3, paras. (21) and (22).
When listing articles and paragraphs, the following format should be used:
E.g., Art. 903, paras. (1), (2), and (3), and Art. 905, para. (1)(a)(2) of the Civil Code.
Do not use a comma between the article number and the paragraph.
When a legislative act is cited for the first time, the place of publication must also be indicated in a footnote, as shown in the following example: Published in the Official Gazette, Part I, No. 233 of September 13, 2020.

  • Court: County Court (e.g., Bacău County Court, Bucharest Sector 4 County Court).
  • Court: Tb. (e.g., Tb. Bucharest, Tb. Alba).
  • Court of Appeals: C.Ap. (e.g., C.Ap. Bucharest, C.Ap. Cluj).
  • The High Court of Cassation and Justice (HCCJ)

  • The division is not abbreviated (e.g., Bucharest Court of Appeal, First Civil Division, Second Civil Division, Division for Juvenile and Family Cases).
  • A judgment, decision, or ruling shall not be abbreviated (e.g., Bucharest Court of Appeal, First Criminal Division, Civil Decision No. 13 of March 22, 2020).
  • Appeals in the Public Interest: Decision No. 1/2012 of the High Court of Cassation and Justice, Panel for the Resolution of Appeals in the Public Interest.
  • Decisions on the interpretation of legal issues: Decision No. 1/2018 of the High Court of Cassation and Justice, Panel for the Interpretation of Legal Issues.
C. Doctrine:
  • Author's name: Use the initial of the first name, followed by the full last name in italics. Ex.: T. Pop, V. Dongoroz, Gh. Beleiu, D. Alexandresco.
  • Title of the work: Use the full title of the work for the first citation, written in regular typeface with the first letter capitalized. Ex.: Treatise on Civil Law, Manual of Criminal Law, Criminal Law: General Part, Civil Law: Persons. If the work consists of multiple volumes, abbreviate “vol.” at the end of the title.
  • Edition of the work: this should be included in the title of the work following the same rules, without abbreviations. Ex.: Course in Civil Law. Persons. 2nd edition, updated; Criminal Law. General Part. 2nd edition.
  • Publisher: Abbreviated as “Ed.” and placed after the title of the work. Ex.: Civil Law. Property Rights, Ed. C.H. Beck.
  • Place of publication: to be written out in full, as published, in uppercase letters.
  • Year of publication: to be written out in full, following the place of publication.
  • Page: Abbreviate as “p.” for a single page and “pp.” for multiple pages.

  • To cite the same work again, use “op. cit.” For example,C. Hamangiu, I. Rosetti-Bălănescu, Al. Băicoianu, op. cit., p. 80.
  • If the same author or group of authors is cited with multiple works, after the first citation, each subsequent citation should include the author’s name and the full title of the work, without repeating the other details (publisher, place, year of publication). Ex.:M. Udroiu, Criminal Law. General Part, p. 13;M. Udroiu, Criminal Law. Special Part, p. 22; M. Udroiu, Summaries of Criminal Procedure. Special Part, p. 400.
  • For consecutive citations, use“idem”if the same work is cited but on a different page, or“ibidem”if the same work and the same page are cited.

E.g.:C. Hamangiu, I. Rosetti-Bălănescu, Al. Băicoianu, op. cit., p. 80.
Ibid.,p. 81.

*Do not use “ibidem” for a footnote following a citation marked “idem.” In this case, the citation should be repeated following the format used by C. Hamangiu, I. Rosetti-Bălănescu, and Al. Băicoianu, op. cit., p. 91.

  • Collective works should be cited as follows:M.A. Hotca,in *The New Penal Code: An Annotated Edition. General Part*. 3rd ed. (collective work), Universul Juridic, 2016, Bucharest, p. 747.

If the collective work has an editor, the following format should be used:A. Andone-Bontaş, in *Code of Criminal Procedure: Commentary on the Articles* (ed. M. Udroiu), p. 397, para. 5.

  • Articles should be cited as follows: G.-A. Lazăr, “Appeal against a tax assessment decision in light of the European Convention on Human Rights,” in R.R.D.P. No. 6/2015, pp. 127–128. 
D. Web pages:
If a source (article, case law, etc.) is cited from an online source, the rules above will apply depending on the source being cited, anda short link will be added at the end.
Ex.:P. Last Name, Title of the work, available at www.juridice.ro (or www.sintact.rowww.scj.ro

II. OTHER INFORMATION:

  • References to a previous section are made using the formula “supra, I.1,” and to a subsequent section using the formula “infra, III.2.”
  • Latin phrases are always written initalics, e.g., tempus regit actum, mutatis mutandis.
  • All footnotes must end with a period. Multiple distinct items within the same footnote (works, legislative acts, etc.) should be separated by a semicolon (;).
  • Always use the double quotation marks on the Romanian keyboard (“ și ”), not the quotation marks found on keyboards in other languages (‘ “).
  • Whenever a parenthesis is nested within another parenthesis, square brackets should be used on the outside and round brackets on the inside.

E.g.: [Art. 123(1) of the Criminal Code] or [even if this was the legislature’s intention (as indicated in the explanatory memorandum), judicial practice has offered a different interpretation].

  • If a footnote is used at the end of a sentence, the superscript in the text that refers to the footnote should appear before the period.
E.g.: However, this interpretation was not accepted by the courts
