În A.U.B.D. – Forum Juridic nr. 1/ 2026 a fost publicat articolul cu titlul „Intervenția judiciară extinsă în materia ordinului de protecție: posibilitatea dispunerii din oficiu a măsurilor de protecție și suplinirea consimțământului victimei pentru purtarea dispozitivului electronic de supraveghere”, redactat de Drd. Maria-Giovanna Rossi. 

In light of the rise in cases of domestic violence and family violence in Romania, this article aims to analyze, on the one hand, the general legal framework governing protection orders, with particular reference to the limitations on the court’s authority to order protective measures without a request from the victim and, in particular, the possibility of waiving the victim’s consent to wear an electronic monitoring device and, implicitly, of fitting the abuser with an electronic monitoring bracelet if the court finds that there is a real and imminent danger to the victim’s life.
