Abstract:In this article, we will focus exclusively on the procedure for approving legislative acts adopted either by Parliament, as the primary legislator, or by the Government, as the delegated legislator.
The constitutionalization of the procedure for reviewing legislative acts with the force of law was achieved through the case law of the Constitutional Court. We refer to the case law regarding the review of normative acts having the force of law by constitutional authorities, whose review powers are provided for either by the Constitution or by law, as well as to the case law regarding the review of normative acts having the force of law by legal authorities, whose review powers are of a legal nature.
In the process of drafting and enacting legislation, certain administrative tasks are carried out by external authorities with the aim of improving the quality of the law, through these authorities’ participation in the development of legislative solutions in specific areas.
