In this article, the author compares tort liability under civil law and under the common law. The principles of civil liability exist only in European law. Tort liability is based on the principle that causing any damage may give rise to a claim for damages. In the common law, there are no general and abstract principles underlying tort liability. However, a set of specific torts has been developed, each with its own definition and its own constituent elements.

The author is skeptical regarding the views expressed in legal doctrine concerning the standardization of civil law and the drafting of a code of torts.
