Corneliu-Liviu POPESCU, Ph.D., Professor, The Unpredictability of Constitutional Litigation Regarding Administrative Litigation

Within a very short period of time (a few months and even on the very same day), the Romanian Constitutional Court issued differing rulings regarding administrative litigation. Subsequently, the Constitutional Court ruled that administrative acts may also be reviewed by ordinary courts, and then that only administrative courts have jurisdiction in such matters. On the very same day, the Constitutional Court ruled that a jurisdiction that is not optional cannot be classified as administrative and is therefore unconstitutional, but also that a mandatory administrative jurisdiction is not unconstitutional. This chaotic and unfounded evolution of constitutional case law runs counter to legal stability, a fundamental principle in a system based on the rule of law.
