Abstract: Enforcement is a fundamental institution of civil procedural law and an essential component of justice in a state governed by the rule of law. Enforcement in light of the European Convention on Human Rights (hereinafter ECHR) is an integral part of the “right to a fair trial.” Merely recognizing the right or obligating the debtor to restore the violated or contested right is often insufficient.

The Moldovan legislature has modernized the enforcement system by reforming it into a private system for the enforcement of civil court judgments.

The subject of this study is the specific features of the procedure for challenging the acts of a bailiff under the laws of the Republic of Moldova.

Keywords: bailiff, enforcement, civil procedure, enforceable document, challenge to enforcement.
