We are currently witnessing an expansion of the legal instruments that national legislators must take into account when drafting legal provisions. Among these, the documents adopted by the institutions of the European Union are undoubtedly the most numerous. With the entry into force of the Treaty of Lisbon, and especially Article 83(2), European criminal law has taken on new dimensions.

The influence of European criminal law on domestic legislation was also clearly evident in the drafting of the new Romanian Criminal Code, which reorganized the offenses contained in the existing Criminal Code and in the numerous special laws that included criminal provisions.

In this regard, it is interesting to analyze the extent to which this influence has manifested itself with respect to offenses involving human trafficking and cybercrime. It can be observed at this level that Romanian criminal law is advanced and generally complies with European regulations, even those adopted after the Code was drafted. Certain issues do arise, however, which may necessitate amendments to the Code or to other laws.
