Dana Apostol TOFAN, Professor, Ph.D., Faculty of Law, University of Bucharest, “The Legal Regime Governing Public Property: Implications for the Work of Public Administration Authorities”
This study aims, based on the constitutional and legal provisions governing public property, to examine certain issues that have arisen in the practice of public administration authorities with responsibilities in this area. Of course, since the institution of public property is extremely broad, only a few aspects are analyzed, taking into account related concepts that are inextricably linked to the concept of public property, such as the concepts of public domain, private domain, and private property. This research is also significant in light of the new provisions regarding public property enshrined in the New Civil Code, which recently entered into force, all the more so because the new legal regime has led to the repeal of a substantial portion of the first special law on the subject—whose title it also changed—Law No. 213/1998.
Keywords: public property, private property, public domain, private domain, public administration.
