Andrei ZARAFIU, Assistant Professor, Ph.D., Faculty of Law, University of Bucharest, General Theory of Legal Acts in Criminal Proceedings
Unlike civil procedure, criminal procedural law does not permit, with regard to legal acts of a procedural nature, semantic equivalence between the concepts of “procedural act” and “processual act.”
Due to the public nature of criminal proceedings and the fundamental principle of officiality in criminal proceedings, all procedural activities and measures are carried out through a complex set of legal acts.
This article seeks to outline the general conditions of the acts through which criminal procedural activity is initiated and carried out, regardless of whether it is of a primary or secondary nature.
These conditions can be viewed as criteria for correctly determining the legal nature and functionality of legal acts in criminal proceedings.
