The protection of personal data is a major component of European Union policy, serving as the primary “spiritus movens” for the implementation of the right to personal data protection in several countries, including Macedonia. It is clear that our lives involve a constant exchange of information, which means that data protection is becoming increasingly important and is moving to the center of the political and institutional system. The protection of personal data when such data is processed for the purposes of preventing, investigating, detecting, and punishing crimes, or for the enforcement of sentences, is of the utmost importance. The use and processing of personal data in criminal proceedings must comply with the law, be expressly and explicitly provided for by it, be exceptional, and be carried out under the supervision of an authority. The supervisory authority must have real and effective powers to intervene in cases of abuse. It is observed that, in general, abuses and manipulations of this right occur when investigative authorities employ special investigative measures.
