This article analyzes the provisions of the future Civil Code regarding divorce, as set forth in Articles 373–380 of the New Civil Code. The commentary on these provisions addresses cases of divorce as well as the applicable procedure. Alongside the provisions governing divorce by mutual consent through judicial proceedings, the commentary analyzes the new elements introduced by the New Civil Code: divorce by mutual consent through administrative proceedings or through notarial procedures.

Finally, the provisions of the New Civil Code regarding divorce on the grounds of fault are briefly analyzed.
