Special civil procedure is governed by the aim of resolving, expeditiously and in accordance with a set of exceptional procedural rules, a civil dispute arising in a specialized area of law. The payment order procedure governed by the new Code of Civil Procedure has two objectives: (1) to optimize this special procedure by drawing on previous legislation and case law in this area; (2) to provide a unified procedural framework for the recovery of certain, liquid, and due claims. This scholarly paper aims to present only the new provisions introduced by the legislature in the new Code of Civil Procedure.
