Part III
Nina Ecaterina GRIGORAŞ, Ph.D. candidate, “Motion to Set Aside. Conditions for Admissibility.”
An action for annulment is an extraordinary remedy, which is provided for in the provisions of the current Code of Civil Procedure as well as in the provisions of the draft of the new code. The admissibility requirements that must be analyzed in advance, prior to examining the grounds invoked, pertain to the judgments that may be challenged in this manner, as well as to the legal avenues for invoking them before this remedy. Given the extraordinary nature of the petition for annulment, the court cannot expand the admissibility requirements for this remedy.
