Part I
Professor Stanley L. PAULSON, Hans KELSEN (in English)
This article analyzes the main theses of Hans Kelsen’s work while also attempting to outline the central debates they have generated in the field of legal theory. By situating Kelsen’s thought and evaluating its reception, the article focuses on the formulation of the “strong” normative thesis and on the role of the transcendental argument in Kelsen’s writings. Taking into account the criticisms raised by this argument, the article proposes an interpretation of the “weak” normative thesis based on Kelsen’s antinaturalism.
Keywords: normativist theory, “strong” normativism thesis, “weak” normativism thesis, obedience to the law, autonomy of law, antinaturalism, pure theory of law
