Parts I–II
Corneliu-Liviu POPESCU, Ph.D., Professor, The Domestic Legal Consequences of the Romanian State’s Conviction by the European Court of Human Rights
To ensure the enforcement of judgments handed down by the ECHR, the Romanian state has adopted domestic legal provisions concerning, in particular, the payment of just satisfaction and the reopening of judicial proceedings (as individual enforcement measures), as well as the amendment of non-conventional legislation and the publication of judgments (as general measures). In addition, there are provisions regarding the recovery of damages suffered by the state and the punishment of those responsible. However, this legislation is incomplete, and its practical application is imperfect.
