Corneliu Liviu POPESCU, Professor, Ph.D., The Relationship Between International Human Rights Law and Romanian Law

In accordance with express constitutional provisions, the relationship between international human rights law and Romanian domestic law is governed by the principles of direct applicability, supremacy (constitutional interpretive value and supra-legislative force), and subsidiarity of international treaty provisions.

As for the case law of international human rights law, the same principles apply, based on the consistent and concordant case law of Romania’s two supreme courts: the Constitutional Court and the Supreme Court of Justice.
