Part III
Corneliu-Liviu POPESCU, Ph.D., Professor, The Committee of Ministers of the Council of Europe’s implementation practice in 2005 regarding judgments of conviction handed down by the European Court of Human Rights in cases against Romania
In carrying out its role as the body responsible for overseeing the enforcement of judgments of the European Court of Human Rights, the Committee of Ministers of the Council of Europe adopted, in 2005, two interim resolutions concerning Romania’s enforcement of judgments finding violations. The Committee of Ministers notes that Romania has fulfilled, within the established time limit, its obligation to pay just satisfaction. Conversely, with regard to general measures designed to prevent the recurrence of similar violations, while in one interim resolution the Committee of Ministers notes legislative and jurisprudential developments, in another interim resolution, noting legislative developments that it nevertheless considers insufficient, it calls on the Romanian authorities to swiftly adopt the necessary legislative reforms.
