Abstract: International labor migration flows include a significant number of migrant workers who, for various reasons, violate the rules of stay in their destination countries. These individuals are considered the most vulnerable category of migrants, prone to serious violations of their fundamental rights. Destination countries have, in practice and universally, adopted policies to restrict and control irregular migration. In this context, the objective of this article is to examine the possibility for irregular migrant workers to benefit from the rights and fruits of their labor, as well as to determine the corresponding limitations and prohibitions that arise in cases of irregularity. The article examines both international instruments and practices, as well as the regional and national approaches of states in this area.
