Abstract: Thearticle presents a comparison between the French model of property and its counterpart as transposed into Romanian law. Although the Civil Code of 1864 entirely copied the French revolutionary model established by the Napoleonic Code, the concept of property was nevertheless influenced by the social and political context in Romania; the evolution of the legislation revealed a break from this trend of adopting models from French law; the current Civil Code remains more faithful to the traditional model of property (the 1864 Civil Code), and is thus closer to the model of the Napoleonic Code than to the current regulations in French law.
